ACCEPTANCE OF TERMS
By accessing our website, booking an appointment, purchasing a product, or enrolling in a membership with Melapop Aesthetics & Wellness ("Company," "we," "us," or "our"), you ("Client," "Member," or "you") agree to be legally bound by these Terms of Use and Privacy Policy. If you do not agree, you may not use our services.
These Terms constitute a binding legal agreement between you and Melapop Aesthetics & Wellness, enforceable under the laws of the States of Georgia and Texas, as applicable based on the location where services are rendered.

ELIGIBILITY
Our services are intended for adults aged 18 and older. By using our website or services, you represent and warrant that you are at least 18 years of age. We do not knowingly collect information from or provide services to individuals under the age of 18.
Melapop Aesthetics & Wellness provides aesthetic treatments, wellness services, product sales, and membership programs. All services are provided subject to a separate Appointment & Service Agreement presented at the time of booking. We reserve the right to refuse service to anyone at our sole discretion.
Results from aesthetic and wellness services vary by individual. Nothing on our website or in our communications constitutes medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider regarding your specific health needs.
5. PURCHASES, PAYMENTS & REFUNDS
All product sales are final. Membership fees are non-refundable. Payments are processed securely through our third-party payment processors, Square and Stripe. By completing a purchase, you authorize us to charge the payment method provided.
Refund and cancellation terms are governed by our Refund, Return & Shipping Policy and Membership Policy, which are incorporated into these Terms by reference.
6. INTELLECTUAL PROPERTY
All content on our website and marketing materials, including but not limited to text, graphics, logos, images, and service descriptions, is the property of Melapop Aesthetics & Wellness and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or use our content without express written permission.
7. USER CONDUCT

9. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Melapop Aesthetics & Wellness, its owners, employees, and agents from and against any claims, damages, losses, or expenses, including reasonable legal fees, arising out of your use of our services or your violation of these Terms.
10. GOVERNING LAW & DISPUTE RESOLUTION
These Terms are governed by the laws of the state in which your services are rendered:

Services rendered at our Georgia location are governed by the laws of the State of Georgia, with disputes subject to jurisdiction in Henry County, Georgia.

Services rendered at our Texas location are governed by the laws of the State of Texas, with disputes subject to jurisdiction in Harris County, Texas.

Online purchases and website use are governed by the laws of the State of Georgia as our primary state of operation.
Any disputes arising under these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in the applicable jurisdiction in accordance with the rules of the American Arbitration Association. You waive any right to a jury trial or to participate in a class action lawsuit.
Under the Texas Deceptive Trade Practices Act (DTPA), Texas consumers retain certain rights that cannot be waived by contract. Nothing in these Terms is intended to waive any rights you may have under applicable Texas consumer protection law.
11. GEORGIA-SPECIFIC CONSUMER RIGHTS
Under the Georgia Fair Business Practices Act (O.C.G.A. 10-1-390 et seq.), Georgia residents are protected against unfair or deceptive acts and practices in consumer transactions. Nothing in these Terms is intended to limit or waive any rights afforded to you under Georgia consumer protection law.
12. TEXAS-SPECIFIC CONSUMER RIGHTS
Under the Texas Deceptive Trade Practices Consumer Protection Act (Tex. Bus. & Com. Code 17.41 et seq.), Texas residents have additional protections against false, misleading, or deceptive acts in trade or commerce. These rights are preserved and nothing in these Terms is intended to supersede or waive your rights under Texas law.

Health & Safety Code 181.001 et seq., the Texas Medical Records Privacy Act), clients have the right to access and request corrections to their health records. 19. PHOTOGRAPHY & IMAGE USE
Before and after photos are collected with your explicit written consent. Photos will not be used for marketing, social media, or any public-facing purpose without a separate signed release. You may withdraw consent for image use at any time by contacting us at hello@melapopaesthetics.com.
20. MARKETING COMMUNICATIONS
By providing your email address or phone number, you may receive marketing communications from us. You may opt out of email marketing at any time by clicking the unsubscribe link in any email. To opt out of SMS communications, reply STOP to any text message. Opting out of marketing communications does not affect transactional messages related to your appointments or purchases.
